phopen Terms & Conditions

By accessing, registering on, or using any part of the phopen platform — including the website at phopen.live, any associated mobile applications, and all games, services, and features offered therein — you ("the User," "you," or "your") agree to be legally bound by these Terms & Conditions ("Terms"), our Privacy Policy, our Responsible Gaming Policy, and any additional rules or guidelines published by phopen from time to time.

These Terms constitute a legally binding agreement between you and phopen ("the Company," "we," "us," or "our"). If you do not agree with any part of these Terms, you must immediately cease using the phopen platform and close your account if one has already been created.

These Terms are written in English. In the event of any conflict between an English version and any translated version of these Terms, the English version shall prevail. phopen operates primarily for users in the Philippines, and these Terms are intended to be read and interpreted in the context of Philippine law and the regulatory framework established by the Philippine Amusement and Gaming Corporation (PAGCOR).

To register and maintain an account on phopen, you must satisfy all of the following eligibility requirements at all times:

• You must be at least 21 years of age, as required under Philippine law and PAGCOR regulations governing online casino gaming.
• You must be accessing the phopen platform from a jurisdiction where online casino gaming is legal and not prohibited by applicable local, national, or international law.
• You must not be a current employee, contractor, director, officer, or agent of phopen, nor an immediate family member of any such person.
• You must not have been previously excluded, suspended, or banned from the phopen platform or any affiliated gaming platform.
• You must have full legal capacity to enter into a binding contract under the laws of the Republic of the Philippines.
• You must not be registered on any self-exclusion list maintained by PAGCOR or any other recognized responsible gaming authority.

phopen reserves the right to request documentary proof of eligibility at any time, including but not limited to government-issued identification (PhilSys ID, passport, or driver's license), proof of address, and proof of payment method ownership. Failure to provide satisfactory documentation within the timeframe specified by phopen may result in account suspension or termination.

Each individual may hold only one (1) registered account on the phopen platform. The creation of multiple accounts by a single individual — whether under the same or different names, email addresses, or payment methods — is strictly prohibited and constitutes a material breach of these Terms.

3.1 Registration Information

When registering, you agree to provide accurate, current, and complete information as prompted by the registration form. You further agree to update this information promptly if it changes. phopen is not liable for any loss or damage arising from your failure to maintain accurate account information.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your phopen account credentials, including your username, password, and any two-factor authentication codes. You agree to:

• Use a strong, unique password that is not used on any other platform.
• Enable two-factor authentication (2FA) via SMS OTP, which phopen strongly recommends for all accounts.
• Notify phopen immediately at [email protected] if you suspect unauthorized access to your account.
• Never share your login credentials with any third party, including family members.

phopen will never ask for your password via email, live chat, or any other communication channel. Any communication claiming to be from phopen that requests your password should be treated as fraudulent and reported immediately.

3.3 Know Your Customer (KYC) Verification

phopen is required by applicable regulations to verify the identity of all users before processing withdrawals and, in some cases, before allowing continued gameplay beyond certain thresholds. KYC verification requires submission of a valid government-issued photo ID and may require proof of address and proof of payment method. Accounts that fail to complete KYC verification within the required timeframe may have withdrawal privileges suspended until verification is complete.

All financial transactions on the phopen platform are conducted in Philippine Peso (₱). phopen accepts deposits and processes withdrawals via the following payment methods: GCash, Maya (formerly PayMaya), BPI, BDO, and Metrobank. Additional payment methods may be added or removed at phopen's discretion with reasonable notice to users.

4.1 Deposits

• The minimum deposit amount is ₱100.
• Deposits via GCash and Maya are typically credited to your phopen account within seconds of confirmation.
• Bank transfer deposits (BPI, BDO, Metrobank) may take up to one (1) business day to reflect, depending on the sending bank's processing times.
• phopen does not charge fees on deposits; however, your payment provider may apply their own transaction fees.
• All deposited funds must be used for gaming purposes. phopen is not a financial institution and does not pay interest on account balances.

4.2 Withdrawals

• Withdrawals are available only to fully KYC-verified accounts.
• GCash and Maya withdrawals for verified accounts are typically processed within 15 minutes during normal operating hours.
• Bank transfer withdrawals (BPI, BDO, Metrobank) are processed within one (1) to three (3) business days.
• phopen does not charge fees on standard withdrawals. Expedited processing requests may be subject to a fee as disclosed at the time of the request.
• Withdrawals will only be processed to a payment method that has been previously used to deposit funds into the account, or to a verified account in the user's own name.

4.3 Chargebacks and Disputed Transactions

Initiating a chargeback or payment dispute with your bank or payment provider in relation to a phopen deposit is a breach of these Terms. If a chargeback is initiated, phopen reserves the right to immediately suspend your account, reverse any associated winnings, and pursue recovery of the disputed amount through all available legal means.

phopen offers various bonuses and promotional offers to registered users from time to time. All bonuses are subject to the specific terms and conditions published alongside each offer, which form part of these Terms by reference. In the event of any conflict between a specific promotion's terms and these general Terms, the specific promotion's terms shall prevail for that promotion only.

• Bonuses are credited to your phopen account in accordance with the terms of the specific promotion.
• All bonuses are subject to wagering requirements, which must be met before bonus funds or winnings derived from bonus funds can be withdrawn. Wagering requirements will be clearly stated in the promotion details.
• Bonuses are non-transferable and may not be exchanged for cash except as expressly stated in the promotion terms.
• phopen reserves the right to modify, suspend, or withdraw any bonus or promotion at any time without prior notice, provided that any modification does not adversely affect bonuses already credited to a user's account.
• Attempting to exploit bonuses through multi-accounting, collusion, or any other form of bonus abuse will result in immediate account suspension and forfeiture of all bonus funds and associated winnings.
• phopen reserves the right to determine, at its sole discretion, whether a user's wagering activity qualifies for a bonus or meets wagering requirements.

All games available on the phopen platform — including live dealer games (baccarat, roulette, blackjack, Dragon Tiger), slot titles, crash games (Aviator), bingo, and sports betting — are governed by the individual game rules published within each game interface. By participating in any game, you agree to be bound by those game-specific rules in addition to these Terms.

6.1 Random Number Generation

All non-live games on phopen use certified Random Number Generator (RNG) systems that have been independently tested and audited to ensure fairness and unpredictability of outcomes. phopen does not manipulate game outcomes in any way. Live dealer games are conducted by human dealers in real time and are subject to the rules of the respective game as displayed in the live game interface.

6.2 Malfunctions and Technical Errors

In the event of a technical malfunction, game error, or system failure that affects the outcome of a game or the crediting of winnings, phopen reserves the right to void the affected game round and return the wagered amount to the user's account. phopen is not liable for any losses arising from technical malfunctions beyond the return of the original wager. Winnings resulting from a clearly erroneous payout (e.g., a software bug that generates an impossible win) will be voided and the correct outcome applied.

6.3 Sports Betting

Sports betting markets on phopen cover events including PBA, NBA, UFC, international boxing, and other sporting events. All bets are subject to the specific rules of the relevant sport and market as published on the phopen platform. phopen reserves the right to suspend, void, or settle markets in accordance with official results and applicable sporting rules.

The following conduct is strictly prohibited on the phopen platform. Engaging in any prohibited conduct may result in immediate account suspension or termination, forfeiture of account balance and winnings, and referral to the appropriate law enforcement or regulatory authorities.

• Registering more than one account, or registering on behalf of another person.
• Providing false, misleading, or fraudulent information during registration or KYC verification.
• Using automated software, bots, scripts, or any other artificial means to interact with the phopen platform or its games.
• Exploiting software bugs, glitches, or errors to gain an unfair advantage.
• Colluding with other players to manipulate game outcomes, particularly in live dealer or poker-style games.
• Engaging in any form of money laundering, fraud, or other financial crime using the phopen platform.
• Attempting to reverse-engineer, decompile, or otherwise tamper with phopen's software or systems.
• Harassing, threatening, or abusing phopen staff, support agents, or other users.
• Using the phopen platform for any purpose other than personal entertainment gaming.
• Accessing the phopen platform from a jurisdiction where online casino gaming is prohibited.

phopen is committed to promoting responsible gaming and minimizing the potential for gambling-related harm. We believe that gaming should be a source of entertainment, not a source of financial stress or personal hardship. The following responsible gaming tools are available to all registered phopen users directly within their account settings:

• Deposit Limits: Set daily, weekly, or monthly limits on the amount you can deposit into your phopen account.
• Session Time Reminders: Receive notifications after a specified period of continuous play to remind you to take a break.
• Cooling-Off Periods: Temporarily suspend your account for a period of your choosing (24 hours, 7 days, 30 days, or 90 days).
• Self-Exclusion: Permanently or indefinitely exclude yourself from the phopen platform. Self-exclusion requests are processed within 24 hours and cannot be reversed for a minimum period of six (6) months.

phopen strictly enforces the 21+ age requirement in compliance with PAGCOR guidelines. Any user found to be under 21 years of age will have their account immediately closed and all deposits returned. phopen does not knowingly allow minors to access its platform and employs age verification measures at registration and during KYC review.

All content on the phopen platform — including but not limited to the phopen brand name and logo, website design, graphics, text, software, game interfaces, promotional materials, and all other intellectual property — is owned by or licensed to phopen and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws of the Republic of the Philippines and applicable international conventions.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the phopen platform for personal, non-commercial entertainment purposes only. This license does not include the right to:

• Copy, reproduce, distribute, or publicly display any phopen content without prior written consent.
• Modify, adapt, translate, or create derivative works based on phopen content.
• Use phopen's brand name, logo, or trademarks in any manner without prior written authorization.
• Scrape, crawl, or systematically extract data from the phopen platform.

Any unauthorized use of phopen's intellectual property may result in account termination and legal action. If you believe that any content on the phopen platform infringes your intellectual property rights, please contact us at [email protected] with full details of your claim.

To the fullest extent permitted by applicable law, phopen, its directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the phopen platform, including but not limited to:

• Loss of winnings or profits due to technical malfunctions, network interruptions, or platform downtime.
• Unauthorized access to your account resulting from your failure to maintain the security of your credentials.
• Decisions made by you based on information provided on the phopen platform, including odds, statistics, or game information.
• Any loss or damage arising from your reliance on the platform's availability or uninterrupted operation.
• Losses arising from events beyond phopen's reasonable control, including natural disasters, government actions, or telecommunications failures.

In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, phopen's liability shall be limited to the maximum extent permitted by law. In no event shall phopen's total liability to you for any claim arising out of or related to these Terms or your use of the platform exceed the total amount deposited by you in the twelve (12) months preceding the claim.

phopen collects, processes, and stores personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By using the phopen platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

phopen complies with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines and takes all reasonable technical and organizational measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. phopen may share your personal data with third parties only in the following circumstances: (a) with your explicit consent; (b) as required by applicable law or regulatory authority; (c) with trusted service providers who process data on phopen's behalf under strict data processing agreements; or (d) in connection with a merger, acquisition, or sale of phopen's business assets, subject to appropriate confidentiality obligations.

phopen reserves the right to amend, update, or replace these Terms at any time. When material changes are made, phopen will notify registered users via email to the address on file and/or via a prominent notice on the phopen platform. The effective date of the revised Terms will be updated at the top of this document.

Your continued use of the phopen platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree with the amended Terms, you must stop using the platform and may request account closure by contacting our support team. phopen will process any pending withdrawals of verified funds in accordance with the Terms in effect at the time of the withdrawal request.

Minor amendments — such as corrections of typographical errors, clarifications that do not materially affect user rights, or updates to contact information — may be made without prior notice. phopen will use reasonable judgment in determining what constitutes a material change requiring advance notice.

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the Philippines. You irrevocably submit to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding in the Philippines.

phopen operates in compliance with applicable Philippine regulations, including those administered by PAGCOR. Nothing in these Terms shall be construed to limit or exclude any rights you may have under mandatory provisions of Philippine consumer protection or gaming law that cannot be waived by contract.

14.2 Formal Dispute Process

If your concern is not resolved to your satisfaction through our standard support channels, you may escalate the matter as a formal dispute. All formal disputes must be submitted in writing to [email protected] with the subject line "Formal Dispute" and must include:

1. Your full name and registered account email address.
2. A clear and detailed description of the dispute, including relevant dates, amounts, and game or transaction references.
3. The outcome you are seeking and the basis for your claim under these Terms.
4. Any supporting documentation, screenshots, or evidence relevant to your claim.

phopen will acknowledge receipt of a formal dispute within two (2) business days and will endeavor to provide a substantive response within fourteen (14) business days. Disputes must be submitted within thirty (30) days of the event giving rise to the dispute. phopen will not consider disputes submitted outside this window except where required by applicable law.
